Water Services (Amendment) Bill 2011 - a brief guide

The Water Services (Amendment Bill) 2011 instructs each water services authority to establish and maintain a register of domestic wastewater treatment systems situated within its area. They are obliged to then establish and maintain a register of these. Each owner will be obliged to apply to the water services authority to have their treatment system included on this register and pay the appropriate fee. The system owner will then be issued with a registration certificate, valid for a 5 year period. An authorised person appointed by a water services authority may ask to see this certificate.

The owner of the treatment system has a number of duties which include ensuring that the system does not:

• Constitute, and is not likely to constitute, a risk to human health or the environment.
• Create a risk to water, air or soil, or to plants and animals,
• Create a nuisance through noise or odours, or
• Adversely affect the countryside or places of special interest,

A person who sells a premises connected to a domestic waste water treatment system, shall furnish a valid certificate of registration in respect of the treatment system concerned to the purchaser of the premises.

The EPA shall maintain a register of inspectors, which will be made available to each water services authority. An inspector may enter and inspect any premises connected to a domestic waste water treatment system and inspect, examine or test it, including any associated fixture, fitting, appliance, plant, drain, service or process.

They may also request information regarding the maintenance and require the production of records or other documents relevant to the maintenance, servicing or operation of the system.
